1. General
These terms of use (in the following referred to as the “Terms “) apply to the mobile application (hereinafter each the “App”, “Apps”, "Game", "Games" or the “Service”) which is available on the Google Play Store and Apple Store or smartphones or tablets.
The Terms apply to any person (hereinafter referred to as the “User” or jointly referred to as the “Users”, “Player”, “Players”) using the App by entering your e-mail address or through the single sign-on of Facebook or Google or Apple , in the App’s dialogue window or menu item provided for this purpose.
SloppyDog Games(in the following referred to as “SloppyDog Games”), and/or its affiliates provide online and mobile gaming services to authorized users (“Services”) subject to the following terms and conditions contained herein, including all Official Rules of the Games played by you (the “Terms”).
BY ACCESSING OR USING THE APP or CLICKING ON THE BUTTON MARKED "ACCEPT" or "I AGREE" YOU SIGNIFY YOUR ASSENT TO THESE TERMS. CHANGES MAY BE MADE TO THESE TERMS FROM TIME TO TIME. YOUR CONTINUED USE OF THE GAMES AND/OR SERVICES WILL BE DEEMED ACCEPTANCE OF THE AMENDED OR UPDATED TERMS. IF YOU DO NOT ACCEPT THESE TERMS, DO NOT DOWNLOAD, INSTALL, USE OR ACCESS THE GAMES OR THE SERVICES.
By accessing or using the App, or by creating an Account, you acknowledge your agreement to be bound by these Terms. If you do not agree to be bound by these Terms, please do not use this App or play any Games contained herein. SloppyDog Games reserves the right to update or modify these Terms at any time, and without prior notice to you. Your use of the App following such modification or update constitutes your acceptance to be bound by these Terms as changed or modified. SloppyDog Games encourages you to read through and review these Terms each time you access the App and utilize the Company Services.
2. About Sponsor
The Sponsor of this App and all Games played on it is SloppyDog Games(“Sponsor”, “we”, “us”, “our”) registered with Hong Kong Commercial Register and it may be changed due to our adjustment.
3. About App
App is an offer to present further gaming applications and enables the User to participate in a reward or bonus program for the active use of the App. The User can earn Virtual In-Game Currencies (hereinafter each the “Coin(s)”, “Cash”, “Point(s)”, "Credit(s)", "Reward(s)") by playing games via the App which may be redeemed against gift cards, premium payment or other rewards, if the User interacted regularly with third party promotions or advertisements.
Please note that App is a No Purchase Necessary Site that provides users with free games and changes to gain and withdraw REAL CASH.
No purchase or payment of any kind is necessary to enter or win any game.
A purchase does not increase your chances of winning. void where prohibited. some games require Virtual In-Game Currencies (“Coin(s)”, “Cash”, “Point(s)”, "Credit(s)", "Reward(s)") to enter. Virtual In-Game Currencies are provided free of charge.
The App, the games, and any sweepstakes contained herein are not sponsored by, endorsed or affiliated in any way with Apple Inc., or other platforms such as Google, Facebook, Amazon or PayPal, and its winnings are void where prohibited and where any bonding or registration is required.
4. Apps and Games
You can play games to earn Virtual In-Game Currencies. The Virtual In-Game Currencies will be added to your In App Balance while you are playing games. Your Virtual In-Game Currencies will be converted into redeemable Virtual In-Game Currency (such as "Cash") every THREE(3) hours (UTC). You can choose to withdraw your remaining balance of redeemable Virtual In-Game Currency (such as "Cash") if you reach the Minimum Payout Threshold ( see 7.(b)Payouts ).
5. About Coin(s), Cash, Diamond(s), Blast Point(s), Point(s), Credit(s), Reward(s)
App offers Users the possibility of collecting Virtual In-Game Currencies for the use of the App. The number of “Coin(s)”, “Cash”, “Point(s)”, "Credit(s)", "Reward(s)" which can be earned per App and the time and content limitation of special offers or special campaigns relating to individual rewards are established solely by SloppyDog Games and can be changed by SloppyDog Games at any time without giving reasons. The User has no legal entitlement in this respect.
Please note that only redeemable Virtual In-Game Currency (such as "Cash") can be redeemed into redeemable goods or withdrawn.
Further, Virtual In-Game Currencies may be limited or withheld in cases where the User has not sufficiently interacted with third party promotions or advertisements and/or if the User’s activity in Apps are unusually low. we guarantee no profits to the User. In particular, the User shall not be entitled to be paid a particular reward.
Virtual In-Game Currencies are a form of virtual currency in the Game. You can use Virtual In-Game Currencies in our discretion, to exchange with other virtual digital goods, or to obtain discounts, offers or other goods or services. Virtual In-Game Currencies are not real money, and do not have monetary value.
You acknowledge that Virtual In-Game Currencies are not real currency. We make no guarantee as to the nature, quality or value of the features of any third-party good or services that will be accessible through the use of Virtual In-Game Currencies, or the availability or supply of Virtual In-Game Currencies. Virtual In-Game Currencies obtained via the Game are provided to you under a limited, personal, revocable, non-transferable, non-sub-licensable license solely to use within the App. Virtual In-Game Currencies cannot be transferred or resold in any manner, including, without limitation, by means of any direct sale or auction service.
You have no property interest, right or title in or to any Virtual In-Game Currencies such “Coin(s)”, “Cash”, “Point(s)”, "Credit(s)", "Reward(s)". Any Virtual In-Game Currencies balance shown in your account does not constitute a real-world balance or reflect any stored value, but instead constitutes a measurement of the extent of your license. We may, at any time, expire free or promotional Virtual In-Game Currencies given to you. You agree that under no circumstances are we liable to you for any damages or claims that may arise from the loss or use of your Virtual In-Game Currencies regardless of the circumstances. You absolve us of any responsibility to maintain or update your Virtual In-Game Currencies account and balance shown in your account. However, if there is a loss of Virtual In-Game Currencies in your account due to technical or operational problems with the Services, we will replace the lost Virtual In-Game Currencies once the loss has been verified. Without limiting any of the foregoing, our maximum liability or responsibility to you is to replacement of the Virtual In-Game Currencies lost.
We will, in our sole discretion, determine and communicate the availability and exchange rate for any Virtual In-Game Currencies, which may be modified at any time. You must comply with any individual limitations as indicated via the App or to get the Rewards. Once Virtual In-Game Currencies has been lost or spent, they will be subtracted from your account and cannot be refunded or returned, except in our sole discretion.
6. Expiration of Virtual In-Game Currencies Virtual In-Game Currencies in Player's Account are not real money, do not have monetary value, and may not be exchanged for anything of monetary value from outside our Services.
If a User doesn’t play App for one hundred and twenty (120) consecutive days, we have the right to clear all Virtual In-Game Currencies (“Coin(s)”, “Cash”, “Point(s)”, "Credit(s)", "Reward(s)") in the User’s account and freeze (or delete) the account permanently.
7. Redemption and Payouts
if we detect abnormal activities from players, we have the right to decide whether to award the prizes. **
(a) Redeeming Virtual In-game Currency: Virtual In-game Currency are earned per person and per Google Advertising ID (or iOS IDFA) only. If a User changes his/her Google Advertising ID (or iOS IDFA) or a User creates and/or uses more than one account he/she may be blocked/deleted and his/her Coins forfeited.
The User can choose the rewards in the “redemption section” of the App. The User can select any reward provided by App for which he/she has collected a sufficient number of Virtual In-game Currency, unless stocks of the selected reward are exhausted
You must comply with any individual limitations as indicated via the App to redeem for a Redeemed Good. You may choose a Redeemed Good that is still available for which you have accumulated sufficient Virtual In-game Currency for redemption. Select the Redeemed Good and follow and instructions to complete the exchange process. As part of the exchange process, you may receive a confirmation email or message from us and/or our designee or partner. Emails or messages will be sent to the email address or other contact information assigned to your account. All acquisitions of Virtual In-game Currency and exchanges for Redeemed Goods are final. Once Virtual In-game Currency have been lost or spent, they will be subtracted from your account and cannot be refunded or returned, except in our sole discretion. No Virtual In-game Currency will be re-credited to your account in the event of a return or exchange of a Redeemed Good, or any problem with any Redeemed Good. Redeemed Good will be processed within fifteen (15) business days from the date in which a request for redeeming is made.
(b) Payouts: User may choose to redeemable Virtual In-game Currency(such as "Cash") for cash. Once User accumulate the equivalent of at least 1 Dollars ($1.00) in their Account (the “Minimum Payout Threshold”), they can cash out by PayPal. Any User with less than the Minimum Payout Threshold will have their redeemable Virtual In-game Currency(such as "Cash") stored in User’s wallet (Player’s account) until they reach the Minimum Payout Threshold. The User has no right to redeem it in the account, and SloppyDog Games has no liability or obligation to offer rewards as long as the User has not accumulated at least the Minimum Payout Threshold of Virtual In-game Currency in the User’s account.
Player can have their Prize payments sent to their PayPal account by providing Sponsor their email address (account name). Sponsor is not responsible for lost or forfeited payouts attributed to Player providing incorrect PayPal account information. Prizes will be processed and remitted within seventy-two (72) hours in business day, from the date and time in which a request for Payout is made. SloppyDog Games may delay or cancel any payout for purposes of preventing unlawful activity or fraud, risk assessment, security, or investigation.
Further restrictions may apply as set above. Users can redeem their Virtual In-game Currency for particular rewards according to an exchange rate established by the SloppyDog Games for each reward. The applicable exchange rate is that of the time of the redemption of the Virtual In-game Currency.
SloppyDog Games also reserves the right to require further information from the Users to ensure that they are not fraudulently using Virtual In-game Currency or other items. SloppyDog Games reserves the right to place any exchange of Virtual In-game Currency in real prizes on hold / stop, for whatever reason, until the requested information has been made available by the User. A sufficient time is given to the User to provide the required information. If the User does not submit the required information, his/her account can be blocked until all requested information has been submitted. If any fraud or other breach of the Terms is detected, SloppyDog Games reserves the right to take further legal action against this person.
8. Taxes, Prize Replacement
User is solely responsible for all applicable federal, state and local taxes for the value of all Redeemed Goods. Except for charitable donations, no transferring of Redeemed Goods or accounts will be permitted. For non-cash Redeemed Goods, the Sponsor reserves the right to substitute the Redeemed Good for one of equal or greater value in the event an advertised Redeemed Good becomes unavailable. Any difference between the actual value of any non-cash Redeemed Good and the approximate retail value set forth in the App rules may not be claimed and will not be awarded.
9. User and User’s Account
The usage of the App requires registration as well as signing up or signing up for a user-account on the App or via Facebook or Google login or Apple login. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password.
You must be eighteen (18) years of age or older and fully contractually capable of using the Services. The Services are limited available to legal residents of the Canada, United Kingdom, United States who are at eighteen (18) years old and the age of majority in his or her jurisdiction of residence and have an Internet connection or mobile phone. In case of doubt, SloppyDog Games is entitled to ask the individual User to submit a documentary evidence of age or contractual capability.
SloppyDog Games reserves the right to refuse service, terminate accounts, terminate your rights to use services, remove or edit content, or cancel Virtual In-Game Currencies its sole discretion. You agree that any termination of your Account and/or your right to use the Services may be effected without prior notice, and acknowledge and agree that SloppyDog Games may immediately deactivate or delete your Account and all related information and files related to your Account and or bar any further access. Further, you agree that SloppyDog Games shall not be liable to you or any third-party for any termination of your right to use or otherwise access your Account or use the Services.
The following rules shall govern each user’s conduct regarding the use of the App.
(a) Unlawful Purposes. In order to create a valuable service to Players, certain types of activities and communications are prohibited. As a condition of your use of the App, each Player agrees that he/she will not use the App for any purpose that is unlawful or prohibited by these Official Rules. Each Player also agrees that he/she is responsible for User Generated Content that is posted by him/her in his/her profile or through other features of the App. No Player may post or transmit any message or image which is libelous, defamatory or which discloses private or personal matters concerning any person other than himself/herself. No Player may post or transmit any message, data, image or program, which is indecent, obscene or pornographic.
(b) Unsolicited Information. This App may provide opportunities to provide us feedback regarding the App, the Games, the Content, the Prizes and our various offerings and other unsolicited submissions (collectively "Unsolicited Information"). Players may only provide Unsolicited Information that conforms to these Official Rules. The Sponsor welcomes comments and feedback concerning the App, but the Sponsor does not accept or consider other unsolicited ideas, including ideas for new advertising campaigns, new promotions, new technologies, processes, games, materials or marketing plans. Accordingly, please do not send such unsolicited ideas to the Sponsor. By providing Unsolicited Information, a Player is thereby granting the Sponsor a perpetual, royalty-free, fully paid up and irrevocable right and license to use, reproduce, modify, publicly display, distribute, transmit, sublicense, create derivative works from, transfer and sell such Unsolicited Information without further obligation to such Player.
(c) Unauthorized access. No Player shall permit any other person (to access the App using his/her account information for any purpose.
BE ADVISED THAT THE SPONSOR IS NOT RESPONSIBLE FOR LOST OR STOLEN USER NAMES AND PASSWORDS (“SECURITY INFORMATION”) AND THAT PLAYERS SHALL TO CONTACT THE SPONSOR IMMEDIATELY IN SUCH EVENT TO CHANGE HIS/HER ACCOUNT ACCESS IN CASE HIS/HER SECURITY INFORMATION HAS BEEN COMPROMISED. PLAYERS ARE FURTHER ADVISED TO KEEP THEIR SECURITY INFORMATION SECURE, AND TO CHANGE IT EVERY 90 DAYS ON THEIR ACCOUNT PROFILE SO AS TO MINIMIZE THE RISK OF FRAUD.
(d) Infringing User Generated Content. No Player shall post or transmit any User Generated Content that would violate the intellectual property, trade secrets or privacy rights of others, including unauthorized copyrighted text, images or programs, photographs, signatures, images, likenesses, voice, trade secrets or other confidential proprietary information, and trademarks or service marks used in an infringing fashion.
(e) Interference with Another Users’ Use. No Player shall interfere with other users’ use of the App, including, without limitation, spamming or otherwise using abusive tactics to deter others from playing the Games or using the App.
(f) Harmful Code. No Player shall post or transmit any file to this App or to any other user which contains viruses, worms, time bombs, Trojan horses or any other contaminating or destructive code.
(g) Abusive Conduct. No Player shall post or transmit any message, communication, video, graphic, audio file or image that is violent, sexually explicit, harmful, threatening, abusive or hateful or otherwise depict illegal activities or drug use. The Sponsor reserves the right to take such action as it deems appropriate in cases where the User Generated Content is being used to disseminate statements or imagery which are deeply and widely offensive and/or harmful. However, the Sponsor is not obligated to take any action.
(h) Abnormal player activities, including but not limited to:
10. License to Use
Subject to your compliance with these Terms, SloppyDog Games grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the App and Company Services. This license does not include any downloading, copying, or other use of information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you in these Terms are reserved and retained by this App or its licensors, suppliers, publishers, rights-holders, or other content/services providers. You may not misuse the App or Company Services and may use the App and Company Services only as permitted by law. The licenses granted by SloppyDog Games terminate if you do not comply with these Terms.
11. Limited Offering of Services
Neither the availability of the App to download, nor the availability of Services shall be construed as an offer or invitation by SloppyDog Games to use download the App or use the Services if you reside in a country or jurisdiction in which such use is forbidden by law the country or jurisdiction is one in which SloppyDog Games in its sole discretion, elects not to offer the Company Services. You are solely responsible for determining whether your use of Company Services is legal in the country/jurisdiction in which you reside and/or in any country/jurisdiction in which you log-on to use Services. SloppyDog Games shall not be responsible for any illegal or unauthorized use of Services.
12. Prohibited Conduct
You shall not, and shall not permit anyone else to, directly or indirectly: (i) modify, reproduce or otherwise create derivatives of any part of the Services or App (including all content contained therein); (ii) reverse engineer, disassemble, decompile or otherwise attempt to discover the source code or structure, sequence and organization of all or any part of the Company Services (except that this restriction shall not apply to the limited extent restrictions on reverse engineering are prohibited by applicable local law); (iii) engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the App or Services, or which, as determined by us, may harm SloppyDog Games or users of our App or Services; (iv) use the Services in any manner that could disable, overburden, damage, or impair the App or interfere with any other party’s use of the Company Services, including their ability to engage in real time activities through the Services; (v) use any robot, spider or other automatic device, process or means to access the Services for any purpose, including monitoring or copying any of the material on the App; (vi) attempt to gain unauthorized access to, interfere with, damage or disrupt any parts of the Services, the servers on which the SloppyDog Games’s data is stored, or any server, computer or database used to provide our Services; (vii) engage in any fraudulent activity or engage in any activity that facilitates fraud; or (viii) otherwise attempt to interfere with the proper working of the Services.
ANY ATTEMPT BY A User OR ANY OTHER PERSON TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE APP OR ITS VULNERABLITY, INCLUDING GAME PLAY AND AWARDING OF PRIZES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS.SHOULD ANY SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT OR OTHER PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING SEEKING CRIMINAL PROSECUTION.
13. Restrictions
The following restrictions apply to the use of the app: (i) You accept full responsibility for any unauthorized use of the Service by parties not authorized to use any of your Accounts. Additionally, you are responsible for any use of your credit card or other payment instrument (e.g. PayPal) incurred by parties using your Account; (ii) You shall not create an Account using a false identity or false information, or on behalf of someone other than yourself; (iii) Without first obtaining the written permission of reward, you shall not register for an Account or in any way use the app if reward has removed, suspended, or otherwise terminated any Account registered for by you, or on behalf of you or if reward has notified you that you may not use the app.
14. Liability & Release
By using the App and Service, you hereby agree to release and hold harmless SloppyDog Gamesand its affiliates, subsidiaries, directors, officers, employees and its advertising, promotional and administrator agencies from any and all liability or any injuries, death, loss, tax liability or damage of any kind arising from or in connection with such User’s use of the App or the acceptance, use, misuse or possession of any Prize won. By using the App, each User further agrees that.
(i) Any and all disputes, claims, and causes of action arising out of or in connection
with Player’s use the App, or any Games played by the Player, Coins earned or Cash
awarded, shall be resolved individually without resort to any form of class action;(ii) Any claims, judgments and awards shall be limited to actual out-of- pocket costs incurred, including costs associated with downloading the App, but in no event
attorney’s fees;(iii) Under no circumstances will any User be permitted to obtain any award for, and User hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have
Damages multiplied or otherwise increased and any other damages, other than damages for actual out of pocket expenses.
These Official Rules and any disputes relating hereto are governed by the internal laws of the Hong Kong SAR, without regard to principles of conflicts of laws. By entering you consent and waive any objection to the jurisdiction of said courts for any such disputes. Using the App constitutes permission to use the name, address (city and state only) and likeness of the Winners for advertising and publicity purposes in any media now existing or hereinafter devised, without further compensation, unless prohibited by law. Failure to comply with these Official Rules may result in forfeiture of any Prize and permanent ban from use of the App. The Sponsor reserves the right, in its sole discretion to disqualify from this or any Game it sponsors, now or in the future, any person it finds, in its sole discretion, has intentionally violated these official rules, tampered with the Tokens or Gaming process, the operation of this App, or any other aspect of the App.
15. Ownership
SloppyDog Games and/or its licensors retain all rights to all data and information on its App and Services, including text, graphics, images, designs, articles, business processes, and any other form of content (collectively referred to as “Content”). Users shall have only those rights in and to the Content that are expressly granted to it pursuant to these Terms, and are otherwise reserved. Reproducing, copying or distributing any Content for any other purpose is strictly prohibited without the express prior written permission of SloppyDog Games. The Services may enable a user to link to websites, and access to content, products or services of third parties. SloppyDog Games is not responsible for any third-party websites, or third-party content provided on or through the App or Company Services. You bear all risks associated with the access and use of such websites and third-party content, products and services. You access third party content at your own risk.
16. Trademarks
All of the trademarks, service marks, and logos displayed on App (the "Trademarks") are registered and unregistered trademarks of the Sponsor, its affiliates, or third parties. Nothing in this App should be construed as granting, by implication, estoppel, or otherwise, any license or right in and to the Trademarks without the Sponsor’s express written permission or the express written permission of the applicable third party. Except as expressly provided in this Agreement, any use of the Trademarks is expressly prohibited.
